Terms of Use

Last updated: November 2026

These Terms of Use (“Terms”) govern your use of this website, operated by Arbor & Maine (“Arbor & Maine,” “we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, please do not use the website.

IMPORTANT: PLEASE READ THE “DISPUTE RESOLUTION AND BINDING ARBITRATION” SECTION BELOW. It requires you and Arbor & Maine to resolve most disputes through binding individual arbitration instead of in court, and it waives the right to a jury trial and to bring or join a class action. You may opt out of arbitration within 30 days, as explained in that section.

An informational website

This website provides general information about Arbor & Maine, a non-clinical behavioral concierge and care-management service based in Texas, serving Dallas–Fort Worth, Houston, Austin and San Antonio, and surrounding communities. Nothing on the website is an offer to provide services to any particular person.

Non-clinical services; no medical advice

Arbor & Maine is not a medical or treatment provider. We do not provide medical, psychiatric, or clinical care, and our Continuity Guides and Connection Specialists do not diagnose, treat, or give medical advice. Nothing on this website is medical, psychiatric, or clinical advice, and it is not a substitute for care from licensed medical or mental health professionals. Always seek the advice of a qualified professional with any questions about a medical or mental health condition.

Emergencies

We do not provide emergency services. If you or someone else is in danger or experiencing a medical emergency, call 911. If you or someone you know is in crisis or thinking about suicide, call or text 988 to reach the 988 Suicide & Crisis Lifeline. Do not use this website or our booking calendar to seek emergency help.

Consultations do not create a client relationship

Booking or attending a consultation does not make you, or anyone you are inquiring about, a client of Arbor & Maine. We provide services only under a separate written agreement with our clients (whom we refer to as “Principals”). Arbor & Maine does not pay or receive referral fees.

No guarantee of outcomes

Every family’s situation is different. We do not promise or guarantee any particular result from our consultations or services.

Our content and brand

The content of this website, including its text, design, images, and the Arbor & Maine name and logo, belongs to Arbor & Maine or is used with permission. You may view the website and print pages for your personal, non-commercial use. You may not copy, modify, distribute, or otherwise use our content, name, or logo without our prior written permission.

Acceptable use

When you use this website, you agree not to:

  • use it for any unlawful purpose or in violation of these Terms;
  • interfere with, disrupt, or attempt to gain unauthorized access to the website or the systems that host it;
  • use automated means to scrape or collect content from the website; or
  • book appointments with false information or on behalf of someone without their authorization.

Third-party services

Consultations are booked through an embedded Google Calendar appointment schedule and held over Google Meet. Those services are provided by Google, under Google’s own terms and privacy policy, and we are not responsible for them. Links to other websites are provided for convenience only and do not mean we endorse them.

Disclaimers

This website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the website will be accurate, complete, uninterrupted, or error-free.

Limitation of liability

To the fullest extent permitted by law:

  • Arbor & Maine will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to this website or these Terms, even if we were told such damages were possible; and
  • our total liability for all claims arising from or related to this website or these Terms is limited to the greater of (a) US$100 or (b) the amounts you paid Arbor & Maine for use of the website in the 12 months before the claim arose. Because use of the website is free, this generally means US$100.

Some jurisdictions do not allow certain exclusions or limitations, so some of them may not apply to you. These limitations apply to your use of this website. Services we provide under a separate written client agreement are governed by that agreement’s terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provisions below.

Dispute resolution and binding arbitration

Please read this section carefully. It affects your legal rights, including your right to go to court.

Try to resolve it informally first

If you have a dispute with us about this website or these Terms, please send a written notice describing it to info@arborandmaine.com. We will try in good faith to resolve it with you within 30 days after we receive your notice. We will do the same if we have a dispute with you.

Binding individual arbitration

If we cannot resolve the dispute informally within 30 days, you and Arbor & Maine agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules, including its Consumer Arbitration Rules where you are a consumer. The arbitration will be seated in Texas. It may be conducted by video conference or based on written submissions, where the rules allow. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. A court may enter judgment on the arbitrator’s award.

Class action and jury trial waiver

You and Arbor & Maine each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. You and Arbor & Maine each waive the right to a trial by jury.

Exceptions

  • Either party may bring an individual claim in small-claims court, as long as it stays there and qualifies.
  • Either party may go to court to seek an injunction or other equitable relief to protect its intellectual property, or to stop unauthorized use of the website.

30-day right to opt out

You may opt out of this agreement to arbitrate by emailing info@arborandmaine.com within 30 days after you first agree to these Terms. Please include your name and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

If part of this section is unenforceable

If the class action waiver is found unenforceable for a particular claim, then that claim (and only that claim) will be decided in court rather than in arbitration. If any other part of this section is found unenforceable, the rest of it will still apply.

Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and change the “Last updated” date above. Your continued use of the website after an update means you accept the updated Terms.
